Terms of Use

1. About these terms

These Terms of Use (the “Terms”) are an agreement between you and nemiria. By downloading, accessing, or using the nemiria app (“nemiria” or “the app”), you agree to these Terms. If you don't agree, please don't use the app.

2. Who we are

nemiria is an independent language-learning app developed and operated from Wellington, New Zealand. You can reach us at hello@nemiria.app.

3. Who can use nemiria

nemiria is intended for people aged 16 and over. By using it, you confirm you are at least 16. nemiria is not directed at children.

4. Your account

nemiria uses passwordless sign-in: you sign in with a link sent to your email address, so keeping access to that email is how you keep access to your account and your saved progress. You're responsible for the email account you sign in with. You can delete your account at any time from within the app; deleting it permanently erases your email and progress (see our Privacy Policy).

5. Your licence to use nemiria

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use nemiria on devices you own or control, for your own personal, non-commercial learning. These Terms don't sell you the app or its content — you're licensed to use it, not to own it.

6. Subscriptions and payments

nemiria offers an optional paid subscription (monthly or annual) that unlocks the full app. Subscriptions are sold and billed through the app store you downloaded from (Apple App Store or Google Play), under that store's terms — we never receive your card details.

• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
• You manage, cancel, or turn off auto-renewal in your Apple or Google account settings — not inside the app.
• Payment is charged to your store account when you confirm the purchase. Prices are shown in the app and at the store before you buy, and may change with notice, as the stores allow.
• Refunds are handled by the app store under its own policies. Because we don't process payments, we can't issue store refunds ourselves.

7. Free and paid features

nemiria has a free plan and a paid plan, and we may change what's included in each over time. If we materially reduce what the paid plan includes during a period you've already paid for, that reduction won't apply to you for that period.

8. Fair use of the app

Please use nemiria fairly. Don't copy, resell, or redistribute the app or its content; don't reverse-engineer, decompile, or extract its content or data except where the law expressly allows; don't use it to break the law; and don't interfere with its operation or security.

9. Our content and intellectual property

nemiria, its name and logo, and all of its content — including the conjugation tables, questions, text, design, and audio — are owned by us or our licensors and protected by intellectual-property laws. Your licence to use the app doesn't transfer any of those rights to you. If you send us feedback or suggestions, you allow us to use them freely, with no obligation to you.

10. Educational disclaimer

nemiria is a self-study practice tool, not professional language instruction, and we are not language teachers or a certifying body. We take care with the content, but we don't guarantee it is error-free, and we don't promise any particular outcome — such as fluency, a grade, or passing an exam. nemiria is not a substitute for a qualified teacher, a formal course, or professional advice. How you use what you practise here is up to you.

11. Disclaimers and your consumer rights

Except for rights you have under laws that cannot be excluded, nemiria is provided “as is” and “as available”, without warranties of any kind. We don't warrant that it will be uninterrupted, error-free, or always available.

Nothing in these Terms limits or excludes any rights or remedies you have under consumer-protection laws that cannot legally be excluded — including, for New Zealand consumers, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, and equivalent laws in the country you live in. Where the law allows us to limit our liability, we do so as set out below.

12. Limitation of liability

To the extent the law allows, we won't be liable for indirect, incidental, or consequential loss, or for loss of data or profits, arising from your use of nemiria. Where we are liable, our total liability to you is limited to the amount you paid us for the app in the 12 months before the event giving rise to the claim (or NZ$50 if you paid nothing). Nothing here limits liability that can't be limited by law.

13. Suspension and ending your use

You can stop using nemiria at any time and delete your account. We may suspend or end your access if you materially breach these Terms or misuse the app. If we do, your licence ends, but the sections that by their nature should continue (such as intellectual property, disclaimers, and limitation of liability) still apply.

14. Changes to nemiria and to these terms

We may update nemiria and these Terms from time to time. If we make a significant change to these Terms, we'll update the date above and let you know in the app or by email. Continuing to use nemiria after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of New Zealand. If you're a consumer, you may also have mandatory protections under the laws of the country you live in, and nothing here removes those.

16. Additional terms for Apple App Store downloads

If you downloaded nemiria from the Apple App Store, the following also apply:

• These Terms are between you and nemiria only, not Apple, and Apple is not responsible for nemiria or its content.
• Your licence to use nemiria is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• nemiria (not Apple) is solely responsible for the app, its content, any maintenance and support, and any product or legal claims relating to it. If nemiria fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
• You confirm you are not located in a country subject to a US Government embargo or designated by the US Government as “terrorist-supporting”, and that you are not on any US Government restricted-parties list.
• You must comply with any applicable third-party terms when using nemiria.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
